Protester decides against injunction

Despite the threat of an injunction after several months of legal battles, the ongoing protests against the sale of alcohol in Lubbock seem to have come to a standstill.
After about a four-month wait, the Texas Alcoholic Beverage Commission began accepting applications last week for permits from stores wishing to sell alcohol.
Lauran Collins, a protester against alcohol in Lubbock, said last week she would file an injunction after the TABC’s decision to issue permits, but after reviewing the situation she decided to not take further action.
“We had three lawyers working all weekend to see whether or not we could do more,” Collins said. “The consensus was an individual couldn’t do anything more about an election, so we are backing out.”
Collins said she could not issue an injunction on the city because two-thirds of voters who participated in the May 9 election voted in favor of the sale of alcohol. Action to stop the sale of alcohol only could have been brought against the TABC for deciding to issue the permits and not rule on the protests.
“We had only three days to sue the TABC, but they are my friends, so we didn’t want to,” Collins said. “They always were doing their job.”
Alright! Lubbock received two bits of good news this week. First, they can look forward to booze in the city in October and secondly, they can expect the return of The Grizz for the Rice game festivities this weekend. I saw Clay at Tom's the other night, and he mentioned something about tailgating west of the United Spirit Arena this season. That could be a decent lead on where you'll be. On a separate note, Friday is my birthday, will you be in town that night?
